End User License Agreement

Effective Date: May 15, 2026

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Sefik Cevik concerning your use of the mobile application "Numtopia" (the "App"). By installing, copying, or otherwise using the App, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the App.

1. License

  • Subject to the terms of this Agreement, Sefik Cevik grants you a limited, non-exclusive, non-transferable, revocable license to use the App on devices that you own or control.
  • You may not rent, lease, sublicense, distribute, sell, or otherwise transfer the App or any rights granted herein.

2. Restrictions

You agree not to, and you will not permit others to:

  • copy, modify, translate, or create derivative works of the App;
  • reverse engineer, decompile, disassemble, or attempt to discover the source code of the App, except and only to the extent that such activity is expressly permitted by applicable law;
  • remove, obscure, or alter any proprietary notices or labels on the App.

3. Child Profiles and Parental Responsibility

  • Numtopia is designed for children and is intended to be installed and managed by a parent or legal guardian. Parents are responsible for setting up child profiles, supervising use, configuring time limits, and managing in-app purchases.
  • The parent area is gated to keep settings, purchases, and progress controls accessible only to parents or guardians.

4. Age Restriction

  • The App is intended for children with parental supervision. If you are under the age required by your jurisdiction to enter into binding agreements, you may only use the App if a parent or legal guardian agrees to this Agreement on your behalf and supervises your use.

5. Payments, Subscriptions and In-App Purchases

  • The App may offer paid features, in-app purchases, or one-time unlocks. All purchases are subject to the terms and policies of the relevant app store (e.g., Apple App Store or Google Play Store).
  • Parents are responsible for managing and authorizing purchases on the device. All fees are non-refundable except as required by applicable law or the app store policies. You agree to pay all fees and applicable taxes for purchases you make.

6. Privacy

  • Use of the App may involve collection and use of information. Our Privacy Policy describes how we collect, use, and disclose information. By using the App, you consent to such collection and use.

7. User Content

  • The App may allow you or your child to create avatars, profiles, or generate printable materials ("User Content"). You retain ownership of your User Content, but by using the App you grant Sefik Cevik a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, and display such User Content as necessary to operate the App for you.
  • You represent and warrant that you have the necessary rights to submit any User Content and that it does not violate any third-party rights.

8. Prohibited Conduct

You must not use the App to:

  • upload or transmit content that infringes the intellectual property or other rights of third parties;
  • upload or transmit unlawful, abusive, harassing, obscene, defamatory, or otherwise objectionable content;
  • attempt to interfere with or disrupt the integrity or performance of the App or its services.

9. Updates

  • Sefik Cevik may provide updates, upgrades, or modifications to the App. This Agreement will govern any upgrades unless separate terms accompany such upgrades.

10. Termination

  • This Agreement is effective until terminated. You may terminate this Agreement at any time by deleting the App and any copies thereof.
  • Sefik Cevik may suspend or terminate your access to the App at any time for conduct that violates this Agreement or where required by law.

11. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Sefik Cevik DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Sefik Cevik BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, USE, DATA, OR OTHER INTANGIBLE LOSSES.

13. Governing Law and Dispute Resolution

  • This Agreement shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of laws principles.
  • Any disputes arising under or in connection with this Agreement shall be resolved in the courts located in Toronto, and you consent to exclusive jurisdiction and venue in those courts.

14. Changes to this Agreement

  • Sefik Cevik may revise this Agreement from time to time. If we make material changes, we will notify you by posting a prominent notice in the App or by other means. Continued use of the App after such changes constitutes your acceptance of the revised Agreement.

16. Entire Agreement

  • This Agreement constitutes the entire agreement between you and Sefik Cevik regarding the use of the App and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.
